Our Services

Digitela Studios provides custom digital modelling services, including the creation of Roblox UGC models.

Depending on the service purchased, the final deliverable may include a digital 3D model supplied as an FBX file.

The exact specifications, requirements, features, delivery timeframe, and price of an order may vary depending on the customer's requirements and the agreement reached between the customer and Digitela Studios.

Customer Accounts

You are required to create an account to place an order through our website.

You are responsible for:

• Providing accurate and up-to-date information.
• Keeping your account credentials secure.
• Maintaining the confidentiality of your password.
• All activity carried out through your account.

You must notify us if you believe that your account has been accessed without your permission.

We reserve the right to suspend or terminate accounts that are used fraudulently, unlawfully, abusively, or in violation of these Terms.

Placing an Order

Before placing an order, customers are responsible for providing accurate information and requirements for the requested model.

This may include:

• Design references
• Images
• Dimensions
• Colours
• Textures
• Technical requirements
• Roblox-related requirements
• Other instructions relevant to the project

Digitela Studios may contact you for clarification if your requirements are unclear or incomplete.

An order is considered accepted once Digitela Studios confirms the order and payment arrangements.

We reserve the right to refuse an order at our discretion, including where the requested work would violate applicable law, Roblox rules, or these Terms.

Pricing and Payment

Prices are displayed or agreed upon before an order is confirmed.

We may accept payment through:

• PayPal
• Stripe
• Bank transfer

Unless otherwise agreed, payment must be received before the final deliverable is released to the customer.

Prices may be changed for future orders. Changes will not affect an order that has already been confirmed.

You are responsible for providing accurate payment information and completing payment through the selected payment method.

Delivery

The final deliverable will normally be provided electronically.

For custom UGC modelling services, the final deliverable will generally consist of an FBX file containing the commissioned model.

Estimated delivery times may be provided before an order begins. Delivery estimates are not guaranteed deadlines unless Digitela Studios has expressly agreed to a fixed deadline in writing.

Delivery may be delayed by:

• Changes to the customer's requirements
• Delays in receiving necessary information or reference material
• Customer-requested revisions
• Technical difficulties
• Circumstances outside our reasonable control

Ownership of the Final Model

Once the customer has paid the full agreed price for an order, the customer owns the commissioned model delivered by Digitela Studios.

This includes ownership of the final custom model represented by the delivered FBX file, subject to the exclusions described below.

Digitela Studios does not retain ownership of the customer's commissioned model after full payment.

However, Digitela Studios retains ownership of:

• Pre-existing intellectual property
• Internal modelling tools
• Software
• Scripts
• Templates
• Workflows
• General techniques and processes
• Reusable assets that were not specifically created for the customer
• Any third-party materials or assets subject to separate licences

Where third-party materials are incorporated into a project, ownership and usage rights may be subject to the applicable third-party licence.

Customer Materials

You may provide images, artwork, logos, references, designs, or other materials for use in your order.

You represent that you have the necessary rights or permissions to provide these materials to Digitela Studios for the purpose of completing your order.

You remain responsible for any copyright, trademark, or other intellectual property issues arising from materials that you provide.

Digitela Studios is not responsible for infringement resulting from customer-provided materials where Digitela Studios reasonably relied upon the customer's representation that they were authorised for use.

Revisions and Changes

Customers may request revisions to their model.

The number of revisions included in an order may depend on the specific service or agreement.

A revision means a reasonable modification to the agreed design or requirements.

Requests that substantially change the original design, add new features, or require significant additional work may be treated as a new project or may incur additional charges.

Digitela Studios will inform the customer before carrying out significant additional chargeable work.

Cancellation and Refunds

Because our services involve creating custom digital products specifically for individual customers, cancellation and refund rights may differ from those applicable to ordinary physical goods.

If you wish to cancel an order, contact Digitela Studios as soon as possible.

Where substantial work has not yet begun, Digitela Studios may, at its discretion, provide a full or partial refund.

Once substantial custom work has been completed, a refund may be reduced or unavailable to the extent permitted by applicable law.

Nothing in these Terms removes or limits any mandatory consumer rights that cannot legally be excluded.

If a final deliverable is materially defective or does not substantially correspond to the agreed requirements, please contact us so that we can investigate and, where appropriate, correct the issue or provide another remedy required by applicable law.

Digital Content and Consumer Rights

Our services may involve the supply of digital content that is made specifically for you.

Where applicable consumer protection laws provide rights relating to digital content or digital services, those rights are not excluded by these Terms.

Where you are a consumer in the UK or European Economic Area, nothing in these Terms is intended to restrict statutory consumer protections that cannot legally be waived.

Prohibited Uses

You must not use our website or services to:

• Break applicable laws or regulations.
• Commit fraud or facilitate fraudulent activity.
• Attempt to gain unauthorised access to our systems.
• Interfere with the operation or security of our website.
• Submit malicious files or code.
• Impersonate another person or organisation.
• Use our services to create content that violates applicable law.
• Provide materials that you do not have permission to use.

We may suspend or terminate access where we reasonably believe these Terms have been violated.

Roblox and Discord

Digitela Studios is an independent business and is not affiliated with, endorsed by, or sponsored by Roblox Corporation or Discord Inc.

Roblox and Discord are separate third-party platforms.

Customers are responsible for ensuring that their use of models, designs, files, accounts, and other content complies with the applicable rules and policies of Roblox, Discord, and any other platform on which they use the deliverables.

Digitela Studios does not guarantee that a particular model will be accepted, approved, uploaded, or monetised by Roblox.

Changes to Roblox's platform, technical requirements, moderation systems, policies, or UGC requirements may affect the usability or compatibility of a model.

Intellectual Property Infringement

Digitela Studios respects intellectual property rights.

If you believe that content provided through our services infringes your copyright or other intellectual property rights, please contact us with sufficient information for us to investigate the matter.

We may take appropriate action where infringement is identified.

Website Availability

We aim to keep our website available and operational, but we do not guarantee that the website will always be available, uninterrupted, secure, or error-free.

The website may occasionally be unavailable due to:

• Maintenance
• Updates
• Technical problems
• Security incidents
• Third-party service outages
• Circumstances outside our reasonable control

Third-Party Services

Our website and services may rely on third-party services, including:

• Stripe
• Discord
• Roblox
• Cloudflare

Your use of these third-party services may be subject to their own terms and policies.

Digitela Studios is not responsible for the availability, security, policies, or actions of third-party services.

Limitation of Liability

To the maximum extent permitted by applicable law, Digitela Studios will not be liable for indirect, incidental, special, or consequential losses arising from your use of our website or services.

This may include loss of profits, revenue, business opportunities, data, or reputation.

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms excludes or limits liability for:

• Death or personal injury caused by negligence.
• Fraud or fraudulent misrepresentation.
• Deliberate misconduct where liability cannot legally be excluded.
• Any other liability that cannot legally be excluded or limited.

Where legally permitted, our total liability relating to a particular order will not exceed the amount paid by the customer for that order.

Indemnification

To the extent permitted by applicable law, you agree to compensate Digitela Studios for reasonable losses, claims, liabilities, and expenses arising from your unlawful use of our website or services, your violation of these Terms, or your infringement of another person's intellectual property rights.

This section does not apply where the relevant loss was caused by Digitela Studios' own unlawful conduct.

Suspension and Termination

We may suspend or terminate your account or access to our website if:

• You materially breach these Terms.
• You engage in fraudulent activity.
• You attempt to compromise our systems.
• You use our services unlawfully.
• You fail to make required payments.
• Your continued use of the service creates a security or legal risk.

Termination does not affect rights or obligations that arose before termination.
